Description

JobSeeker Payment (JSP) single principal carer receiving Pensioner Education Supplement (PES)

The customer is a JSP single principal carer getting PES due to undertaking a part-time Bachelor course at university. They start the course on 4 March and get PES and EdEP. If their study is continued, they will be entitled to another EdEP in 12 months. The system will generate a Manual Follow Up (MFU) in 12 months to check eligibility for EdEP.

Job seeker (short course)

Customer is a job seeker undertaking a short course. They are provider managed with approved study included in their Job Plan. They are entitled to one EdEP for their short course. If the customer starts another short course within the same 12 month period, they will not get a second EdEP for this course.

JSP transferring to Austudy

Customer is currently a job seeker transferring to Austudy to start a full-time Bachelor degree at university. They are entitled to EdEP due to starting a course and transferring to Austudy. This entitles them to only one EdEP as Austudy is not a qualifying payment for EdEP to be paid in the future.

Parenting Payment (PP) single receiving PES

Customer is getting PP single and PES, undertaking a Bachelor course at university. The course started in second semester, and they received a payment of PES and EdEP on 24 July. They are only eligible for one EdEP payment per calendar year. As a continuing student, they will be entitled to EdEP again in early January the following year. A MFU is generated to check eligibility to future entitlement.

Description

Continuous receipt of ISP for the purpose of attracting EdEP

Customer has been receiving JSP for over 12 months and undertaking an approved short course. Their payments have been suspended twice with a non-payment period of 6 weeks. Regardless, they are entitled to EdEP because they have been on ISP continuously for 12 months under Social Security Act 1991, section 38B, Notional continuous period of receipt of income support payments (austlii.edu.au).

Continuous receipt of ISP for the purpose of attracting EdEP, period of non-payment less than 13 weeks

Customer was receiving JSP for more than 60 weeks when they cancelled their payment due to gaining employment. After 12 weeks, they became unemployed and restarted on JSP. They also undertake an approved short course. Therefore, they are entitled to EdEP as they are considered to have been receiving an income support payment for 12 months or more under Social Security Act 1991, section 38B, Notional continuous period of receipt of income support payments (austlii.edu.au).

As the customer was receiving ISP for a long time (over 12 months) the non-payment period can be counted as a period of income support, provided it is not longer than 13 weeks. The period of up to 13 weeks can be made up of several such periods.

Continuous receipt of ISP (which is not their current payment) continuously for 12 months

Customer was receiving Youth Allowance (student) for 46 weeks and transferred to JSP when their course finished. After 10 weeks of being on JSP, the customer decides to return to study for a year and claims for Austudy (student).

As the customer was receiving JSP immediately before their new course starts and they were receiving an income support payment continuously for at least 12 months, they are entitled to EdEP under Social Security Act 1991, section 38B, Notional continuous period of receipt of income support payments (austlii.edu.au).

Continuous receipt of ISP but income support cancels within 12 month period - cancellation falls within 6 weeks of 12 month anniversary date

A customer may still be considered to be in continuous receipt of ISP for a 12 month period if:

  • their ISP cancels within 12 months of their grant date
  • the cancellation falls within 6 weeks of the 12 month anniversary date

This is separate to a customer having less than 13 week gap within the 12 month period.

Example:

Sam receives an ISP for 48 weeks before their payment cancelled on 1 December 2023 due to employment income. Sam’s 12 month anniversary payment date would have been 1 January 2024.

As the cancellation of the ISP fell within 6 weeks of their 12 month anniversary, they are still considered to be on a continuous payment under Social Security Guide, 1.1.N.130, Notional continuous period of receipt of income support payments (JSP, YA).

Sam also had a non-payment period of 10 weeks between 1 December 2023 and 9 February 2024.

As Sam's ISP was cancelled within 6 weeks of their 12 month payment anniversary date and had a non-payment period shorter than 13 weeks, they meet the continuous receipt of income support criteria for EdEP.

Continuous receipt of ISP but income support cancels within 12 month period - cancellation falls more than 6 weeks from their 12 month anniversary date

A customer is considered not to be in continuous receipt of an ISP for a 12 month period when:

  • their ISP cancels within 12 months of their grant date
  • the cancellation falls more than 6 weeks from their 12 month anniversary date

Example:

John receives income support payment (ISP) for 46 weeks before their payment cancelled on 12 November 2023 due to employment income. John’s 12 month anniversary payment date is 1 January 2024.

As the cancellation of the ISP fell more than 6 weeks from their 12 month anniversary, John is not considered to be on a continuous payment and therefore not entitled to EdEP under Social Security Guide, 1.1.N.130, Notional continuous period of receipt of income support payments (JSP, YA).

Continuous receipt of ISP but income support cancels within 12 month period and customer has a 15 week non-payment period

A customer is not considered to have met a 12 month continuous payment period if their ISP:

  • cancels within 12 months of their grant date, and
  • the cancellation falls within 6 weeks of their 12 month payment anniversary, and
  • they commence a non-payment period greater than 13 weeks, and
  • the non-payment period falls over their 12 month payment anniversary date

Example:

Pam receives ISP for 48 weeks before their payment cancelled on 3 December 2023 due to employment income. Pam’s 12 month payment anniversary date is 7 January 2024.

Pam reclaims a JSP on 10 March 2024 and continues to receive ISP until today (21 March 2024).

As the cancellation of the ISP fell within 6 weeks of their 12 month anniversary, they met subsection 3 of under Social Security Act 1991, section 38B, Notional continuous period of receipt of income support payments (austlii.edu.au).

However, Pam had a non-payment period greater than 13 weeks between 3 December 2023 and 10 March 2024.

As Pam’s ISP was cancelled within 6 weeks of their 12 month payment anniversary date, but the total period in which they did not receive an ISP was 14 weeks, Pam does not meet the 13 week rule in subsection 4 of Social Security Act 1991, section 38B, Notional continuous period of receipt of income support payments (austlii.edu.au).

The 12 month continuous period will restart from 10 March 2024.

Pam has not met the criteria for continuous entitlement and is not entitled to EdEP.
