No. The election for a non-care non-enforcement period must be made during the 'overall non-care period'. This period ends when the child returns to the payee's care and the administrative option is no longer available.

The payer is unemployed, but does not receive a social security benefit as their new partner is employed. Can they apply for a low-income non-enforcement (LINE) period? + Read more ...

No. The liability is suspended when the payer receives a social security pension or benefit. A payer cannot apply for a LINE period unless they receive a pension or benefit. The payer would need to make an application to the court to have the order varied.

How do I process a Form 2? Or What do I do if the payer provides the court order to us? + Read more ...

Where a Service Officer receive a Form 2, follow the normal procedure with the following changes:

  • Go through the Payer’s involvement list to enter the new registration
  • Check/tick the payer button under ‘applicant is’ on the case screen
  • Enter the Payee using the select arrow for ‘other party’
  • Payer notifications will be private collect except where the payee elects during the registration interview, to have Child Support collect. If this occurs, receipt an AFC and the usual provisions for AFC's will apply. Note: there are no arrears collectible under the AFC as this is the first time that the payee has sought collection by us. (s25 R&C Act)
