This document outlines the process when a Child Support customer declares bankruptcy.

Bankruptcy

Bankruptcy is a process that occurs when people who cannot pay their debts give control of their finances to a trustee (by agreement or court order), in exchange for protection against legal action from creditors. The trustee is responsible for managing the debt owed by the bankrupt person during the bankruptcy period. The sequestration date is the date the customer was declared bankrupt.

Roles and responsibilities

Service Officer

  • recording a bankruptcy
  • maintaining the bankruptcy record
  • discharging the bankruptcy record

Service Support Officer/Service Officer (SO5)

  • issuing a proof of debt notice to a bankruptcy trustee
  • assist Service Officer in providing advice regarding relevant decision making; complex issues or when the Service Officer requires assistance
