Child Support (Assessment) Act 1989

The relevant provisions for communicating protected information are:

  • Section 150(3) (a) to (d) and (f) - to specified external persons, but excluding section 150(3) (e)
  • Section 150(3) (e) - concerning a credible threat to a person
  • Section 150(4) - to a person with sufficient interest - but excluding section 150(4G)
  • Section 150(4E) (a) (b) (ii) (iii) and (c) - for purposes relating to a deceased person
  • Section 150(4G) - to a payee for the purposes of the payee's proceedings under section 113A of the Registration and Collection Act, to enforce the debt
  • Section 150(5) - to a court, where necessary for the purposes of the Act

Child Support (Registration and Collection) Act 1988

The relevant provisions for communicating protected information are:

  • Section 16(3) (a) to (d) and (f) - to specified external persons, but excluding section 16(3)(e)
  • Section 16(3) (e) - concerning a credible threat
  • Section 16(4) - to a person with sufficient interest - but excluding section 16(4G)
  • Section 16(4E) (a) (b) (ii) and (iii) - for purposes relating to a deceased person
  • Section 16(4G) - to a payee for the purposes of the payee's proceedings under section 113A to enforce the debt
  • Section 16(5) - to a court, where necessary for the purposes of the Act
  • Section 113(2) - to keep a payee informed of recovery action (as appropriate)

Child Support Services, Delegations and Authorisations

There are a number of different authorisations and delegations in relation to the communication of protected information.

Staff must check they have the appropriate authorisation before communicating any protected information.
