Examples - customer contact after making a care determination

This table provides examples to assist with customer contact after making a care determination.

Example 1

Jenny advised their care for Maddison has increased from 14% to 35% from 6 May 2022, Muhammad confirmed Jenny’s level of care increased but disagreed with the date of event, advising the care did not change until 10 June 2022.

The disagreement about care arrangements was referred to Integrated Care who contacted both customers to gather information and request evidence. During these conversations, the expected outcome (child support payable for Maddison decreasing) was discussed. Letters were issued to both customers asking for evidence to support their claims.

Jenny provided evidence - text messages between Jenny and Muhammad, a calendar showing nights they had care of Maddison since 6 May 2022 and a third party statement. Muhammad did not provide any evidence.

Jenny’s evidence was discussed with Muhammad. They advised they were not going to provide any additional information or evidence to support their claim that the date of event was 10 June 2022. During this conversation, the likely decision was discussed.

A decision was made to accept the change in care based on the evidence provided by Jenny for date of event 6 May 2022. The child support payable for Maddison decreased as a result of the decision.

Contact is not required with Jenny or Muhammad after making the care determination as neither customer requested contact, and there are no unexpected outcomes.

Example 2

Henry advised their care for Charlotte increased to from 50% to 65% from 13 June 2022, Henry stated that Linh would disagree that there had been a change in care.

The disagreement about care arrangements was referred to Integrated Care who contacted both customers to gather information and request evidence. During these conversations, the expected outcome if the care change was accepted (roles reversing and Linh becoming the paying parent) were discussed. Letters were issued to both customers asking for evidence to support their claims.

Henry provided evidence - a calendar showing nights they had care of Charlotte since 13 June 2022 and a letter from Charlotte’s school.

Henry’s evidence was discussed with Linh who advised they would provide evidence by the due date. Linh was advised that if evidence is not received a decision would be made to accept the change in care. This would result in a role reversal and employer withholding would be established.

Linh did not provide any evidence. A decision was made to accept the change in care based on the evidence provided by Henry. An updated income was received for Linh resulting in the assessment being a nil rate.

One genuine attempt to contact both Henry and Linh is required after making the care determination to discuss the unexpected outcome.
