Asylum seekers who enter Australia without valid documentation are considered illegal maritime arrival Illegal maritime arrivals are not granted a permanent protection visa. They are granted a temporary visa. These visa holders do not qualify as refugees under the Social security Act 1991:
The visas above may allow the holder to be considered a refugee child for a DOP claim under section 995 of the Social Security Act 1991. |

Eligibility for payments and services Although holders of visa subclasses 060, 447,449,451, 695, 785, 786 and 790 (and 070 Bridging Visa R(Removal Pending)) are not permanent residents. Department of Social Services Ministerial Determinations allows them to qualify for Special Benefit (SpB) and be exempt from the SpB Newly Arrived Resident's Waiting Period. This also qualifies them for family assistance, ancillary payments and concession cards. They are Fully Eligible Participant (FEP) for employment services through Workforce Australia and are also eligible for the Adult Migrant English Program (AMEP). |

Visa subclasses 447, 451and 695 remain valid until expiry While visa subclasses 447 (Secondary Movement Offshore Entry), 451 (Secondary Movement Relocation) and 695 Return Pending were abolished from 9 August 2008, visas already issued under subclasses 447, 451 and 695 will remain valid until they expire or the holders are granted another visa. |

Note: 785 visas granted from October 2013 onwards are not eligible to apply for the 851 Resolution of Status (Permanent) (Class CD) Visa. |
