This document explains details about how to help manage enquiries from individuals, the media and healthcare providers about Share by Default.
Overview
A bill amending the My Health Records Act 2012 has been tabled in the Australian Parliament. If passed, the changes to legislation will require healthcare providers to share key health information to the My Health Record system by default.
This will start with and means the proposed requirement to upload is limited at this stage to:
- pathology, and
- diagnostic imaging reports
The Australian Government has not indicated a timeframe for when these changes would come into effect. Before allowing the legislation, Services Australia expects to get enquiries from:
- pathology and diagnostic imaging organisations
- other healthcare providers
- individuals/carers, and
- the media
Share by Default expects to expand to other healthcare providers over time. The list above will be updated as more services are included in the requirement to upload.
Individuals can:
- set privacy and access controls to manage who has access to their pathology and diagnostic imaging reports once they are uploaded to My Health Record, or
- ask a healthcare provider not to upload a report to their My Health Record
This legislation does not change the existing privacy and access controls in My Health Record.
Legislation being amended includes:
- My Health Record Act 2012
- Health Insurance Act 1973
