Applying an Administrative Review Tribunal (ART) decision to a Child Support Assessment 277-26041407



This document outlines the process once the ART has finalised a review of a child support decision.

Decision received from the ART

Once a decision is made, the ART will notify the customers within 14 days of the date of the decision. The ART will email Child Support a copy of the decision within 24 hours of the decision being sent to the parties.

The ART can:

  • vary the decision
  • dismiss the application
  • set the decision aside and substitute a new decision
  • affirm the decision
  • set the decision aside:
    • and send back for reconsideration and Extension of Time (EOT) decisions, or
    • s103 (ART Act) - Powers of ART if parties reach an agreement. A s103 has the effect of affirming, varying or setting aside a decision. Process the decision accordingly
    • change of assessment (COA) Refusal - The decision under review is set aside and the Tribunal substitutes a new decision that, pursuant to section 98E of the Child Support (Assessment) Act 1989, the issues raised are ‘too complex’ to be dealt with under Part 6A of that Act and refuses to make a departure determination without taking any further action under that Part
  • withdraw a decision

Roles and responsibilities

Child Support & Tailored Services Division

Service Officers at the APS3 and APS4 level

  • Communicate with the ART in relation to administrative matters
  • Manage appeals records in Cuba and the Tribunal Records Management Database
  • Prepare the ART file
  • Despatch the file to the ART and the parties
  • Process the ART decision
  • Finalise the appeals process
  • Store and transfer ART documents
  • Make non-complex applications to prohibit disclosure of documents or information to the ART

Service Support Officers (SSO)

  • Check documents for completeness and compliance with privacy provisions
  • Make decisions to escalate 'exceptions' to their Team Leader
  • Provide guidance to APS3 and APS4 Service Officers for escalated matters
  • Make complex applications to prohibit disclose of documents or information to the ART

Note: Service Officers below the APS5 level who have the support from their team leader may carry out the roles and responsibilities of an SSO.

Program Officers at the APS 5 level

  • Manage the Appeals Support Team (AST) mailbox
  • Communicate with the ART in relation to administrative matters
  • Create and manage appeals records in Cuba and the Tribunal Records Management Database
